BAY HARBOR ISLANDS, Fla., Dec. 8 /Christian Newswire/ -- When Sondra Snowdon wanted to erect a nativity display, the Town of Bay Harbor Islands stopped her.

In a "Consent Judgment and Order" with the U.S. District Court for the Southern District of Florida, Miami District, the Town of Bay Harbor Islands admitted they had violated the Constitutional rights of Sondra Snowdon by denying her the "Freedom of Speech," "Freedom of Religion" (1st Amendment) and "Equal Protection" (14th Amendment) on Causeway Island within town limits. The Consent Judgment also states that Ms. Snowdon is now "permitted to sponsor or erect unattended holiday and/or religious displays of her own choosing" for the next 10 years.

The Town Council then enacted Resolution No. 988 to comply with the Consent Judgment, however Resolution 988 added a "prohibition on ceremonies and other activities involving the physical presence of people on [Causeway Island] after the erection of the display" that was not part of the Consent Judgment in order to keep Ms. Snowdon, or other individual, church or group from holding religious services of any kind, even if just singing Christmas Carols... again violating 1st Amendment Rights.

Ms. Snowdon appealed the Consent Judgment however the 11th District ruled that there was nothing wrong with the Southern District's affirmation of Consent Judgment itself... rather the problem was with Resolution 988, which had not yet been properly attacked in any court.

Ms. Snowdon will now bring an action in Federal Court regarding the further violation of her 1st Amendment Rights only without necessarily alleging violation of her 14th Amendment rights because Resolution 988 applies to everyone in the Town of Bay Harbor Islands.
