WICHITA, Kansas, Dec. 22 /Christian Newswire/ -- In a press conference held Friday afternoon, Attorney General Phill Kline told reporters that he would seek to have 30 charges reinstated against abortionist George R. Tiller after Judge Paul W. Clark granted a motion made by Sedgwick County District Attorney Nola Foulston to have them thrown out.
"We are pursuing a legal remedy to what we consider a flawed decision by a district court judge," said Kline.
Foulston, an abortion supporter and personal friend of Tiller’s, asked for the case to be dropped because she had not been consulted prior to the filing of the charges, as Kansas law requires. However, Phill Kline told reporters that he met with Foulston in her Wichita office just prior to his filing the case against Tiller in the presence of three other people. He said Foulston told him she had no problem with him filing the charges. The allegations in the criminal complaint all deal with criminal late-term abortions.
Kline stated that he was not notified of the motion until after the case had been dismissed. He said he was flying an attorney to Wichita late Friday to find Judge Clark, who was not returning his calls, in order to file an emergency motion for reinstatement.
“Foulston obviously isn’t telling the truth here,” said Operation Rescue President Troy Newman. “If Foulston in fact lied to a judge, that could be considered obstruction of justice, and would be further evidence of the massive corruption that has covered up for Tiller’s wrong-doing for years.”
“We have every confidence that Kline will prevail once his side of the matter can be heard,” Newman said.
“These charges are very serious, and it would be a travesty of justice not to have them heard in a court of law,” said Newman. “We are talking about illegally taking the innocent lives of viable babies who should have had the protection of law."
“If the charges have no merit, then let’s have a hearing and determine that. But since they likely do have merit, we can expect Tiller and his lawyers to pull every underhanded trick in the book to keep Tiller from having to answer for these crimes. We are likely to see much more of these shenanigans if Kline is able to get the charges reinstated, as we believe he will.”
